Section 2: When Marriages Fail


Divorce and separation are commonplace in our society, and the ratio of divorces to marriages seems to be increasing. People have many theories about why marriage breakdown is increasing in frequency, but one thing is certain, it is having an impact on the laws governing family relationships.

In this section, you will examine the laws involved in divorce and separation. When you have finished the section, you should be able to explain:
    • how a divorce is obtained,
    • what divorcing parents' responsibilities are to their children,
    • how property is divided up when a marriage fails, and
    • the function of a marriage contract.
